Terms of Service and Acceptable Use Policy

Terms of Service

These Terms of Service (this “Agreement”) govern the use of and access to our services made available on our website at https://www.tbc.co/ (the “Service”), together with any related software, models (including our proprietary neurally-optimized model, APIs, and documentation we make available through the Service (collectively, the “Software”).  By registering for, accessing, or using the Service or Software, you agree to be bound by this Agreement and to use the Service and Software in compliance with this Agreement.

BEFORE YOU CLICK ON THE “I AGREE” BUTTON, CAREFULLY READ THE TERMS OF THIS AGREEMENT.  BY CLICKING ON THE “I ACCEPT AND AGREE” BUTTON, REQUESTING AN INVITATION, ACCEPTING AN INVITATION, CREATING OR REGISTERING AN ACCOUNT, ACCESSING, OR USING THE SERVICE, YOU ARE AGREEING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT, AND YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD AND HAVE THE AUTHORITY TO ENTER INTO THIS AGREEMENT.  The Service is not offered to any person or entity barred from receiving it under applicable law, including persons located in, or ordinarily resident in, any sanctioned or embargoed jurisdiction, or on any applicable restricted-party list. You are responsible for compliance with all laws applicable to your use.

IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF AN ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE ALL NECESSARY AUTHORITY TO BIND SUCH ENTITY, AND SUCH ENTITY WILL BE DEEMED THE CUSTOMER AND USER PURSUANT TO THIS AGREEMENT.  IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT ACCESS OR USE THE SERVICE.

The terms “you,” “your,” and “yours” refer to you, the customer registering for or using the Service or Software.  The terms “TBC,” “we,” “us,” and “our” refer to Biological Black Box, Inc. d/b/a The Biological Computing Co.  We may periodically make changes to this Agreement, and you may view the most current version at www.tbc.co/terms-of-service. It is your responsibility to review the most recent version of this Agreement frequently and remain informed about any changes to it.

ARBITRATION NOTICE.  Except for certain kinds of disputes described in the Section titled “Dispute Resolution and Arbitration”, you agree that disputes arising under this Agreement will be resolved by binding, individual arbitration, and BY ACCEPTING THIS AGREEMENT, YOU AND TBC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.

Not a Commercial Release

TBC has not commercially released the Service or the Software, and the Service and Software have not yet been tested like other commercially released services or software that you may use.  Therefore, it is likely that the Service and Software will be incomplete and will contain errors. The Services may change materially or be suspended or discontinued at any time, in whole or in part, with or without notice.  If you do not wish to accept the risk of errors in the Software, please do not use the Service or Software.  Furthermore, TBC is not obligated to correct errors, correct the effects of errors (e.g., fix your computer or recover lost data), or provide any technical support related to use of the Service or Software.  TBC makes no commitment regarding availability, uptime, service levels, or support, and may add, remove, or modify features, and may impose or change usage limits, at its discretion.

Because the Service uses experimental artificial-intelligence models, the videos and other content it generates (“Output”) may be inaccurate, incomplete, offensive, or otherwise unexpected, may not be unique to you, and should not be relied upon. TBC is not responsible for any Output or any use of or decisions made using such Output. 

The Service and Software have not been made available to the public and TBC desires to maintain the confidentiality of the Service and Software until it is commercially released.  Accordingly, you will take reasonable steps to maintain the confidentiality of and not disclose to any third party: (a) all non-public information disclosed by TBC to you under this Agreement; and (b) all Feedback, Service and Software performance data, and all other non-public information obtained through your testing, evaluation, and use of the Service or Software.  Furthermore, in order to protect the trade secrets and proprietary know-how contained in the Software, you will not decompile, disassemble, or reverse engineer the Software.  You agree to promptly report any breach of this section to TBC, and you acknowledge that TBC may seek injunctive relief (without the need to post a bond) to prevent any actual or threatened breach.

Feedback

To the extent you provide any feedback concerning the Service and Software, including identifying potential errors and improvements (“Feedback”), you hereby grant TBC a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, transferable, non-exclusive right and license to use, reproduce, disclose, distribute, modify, and otherwise exploit your Feedback without restriction, including to improve the Service, Software, and TBC’s models, and to create other products and services.

Account Registration

Access is by invitation only.  You must register for and maintain an account with us to use the Service.  When you register, we collect certain information from you, including your name, email address, company or organization, and information about how you intend to use the Service.  Any personal data that we collect, store, or otherwise process in connection with the Service hereunder is subject to our Privacy Policy currently available at www.tbc.co/privacy-policy. When registering, you must provide accurate and complete information about yourself and promptly update this information.  If you provide any information that is inaccurate or incomplete, or we have reason to believe that the information is inaccurate or incomplete, we may suspend or terminate your account and your use of the Service.

Only you are authorized to use your account to use the Service and conduct other activities with us.  You are responsible for maintaining the confidentiality of your login information and for all activities that occur through your account.  To protect your account from unauthorized use, keep your user identification and password secure and do not provide this information to anyone else.  Please notify us immediately of any unauthorized use of your account or any other breach of security.

Fees

Unless we note otherwise, the Service and Software are provided to you free of charge.  We reserve the right to change our fees or billing methods at any time by providing you notice of any change.  If any change is unacceptable to you, you may terminate your account. 

Term; Termination

This Agreement will start on the earliest of (a) the date you accept this Agreement and (b) the date you first register for, access, or use the Service, and will end when either you or we terminate your account as set forth in this Agreement.  You have the right to terminate your account at any time.  Termination of your account is your sole right and remedy with respect to any dispute with us regarding the Service, the Software, or this Agreement.

We may terminate your account at any time for any reason by providing you with notice in any reasonable manner, including via email and via notices posted on the Service.

Your rights under this Agreement will terminate automatically if you breach any part of this Agreement.

Sections that by their nature should survive will survive termination.

Access to the Service; Modifications to the Service

We do not provide you with the equipment to access the Service or use the Software.  You are responsible for all fees charged by third parties to access the Service (e.g., data charges by wireless carriers).

We reserve the right to modify or discontinue, temporarily or permanently, all or a part of the Service without notice.  We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

Acceptable Use; Restrictions

Subject to the terms of this Agreement, you may use the Service for your own personal or commercial use.  Your use of the Service and Software is also subject to our Acceptable Use Policy, available at www.tbc.co/terms-of-service, which is incorporated into this Agreement by reference.  Violation of the Acceptable Use Policy is a material breach of this Agreement. We may remove or disable access to any content and may suspend or terminate your access, with or without notice, for any actual or suspected violation.

License and Access to the Service

Subject to your compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service, and to use any Software solely as necessary to access and use the Service, in each case during the term of this Agreement and solely for your own personal or commercial use.  This license expires when we no longer provide the applicable Service or your account is terminated, whichever occurs first, and you will cease all use of the Service and Software at that time.

Intellectual Property

Except for the license granted to you in the Section titled “License and Access to the Service), we (and our licensors) retain all right, title, and interest in and to the Service and Software (including our proprietary neurally-optimized model and all other models and technology underlying the Service), including all related intellectual property rights. The Service and Software are protected by applicable intellectual property laws, including United States copyright law and international treaties.

Except to the extent the applicable restriction is expressly prohibited by applicable law, you will not, and will not permit or authorize third parties to: (a) reproduce, modify, translate, enhance, decompile, disassemble, reverse engineer, or create derivative works of the Service, Software, or any portion thereof; (b) rent, lease, or sublicense the Service, Software, or any portion thereof, or make the Service, Software, or any portion thereof available to any third party; (c) circumvent or disable any security or technological features or measures in the Software; (d) extract, copy, or attempt to derive any model weights or parameters of the Service or Software; (e) use the Service or any Output to train, develop, or improve any competing model or service, including by distillation; or (f) remove or alter any proprietary notices.

User Content; Output

The images, text prompts, and other materials you upload or submit to the Service are your “User Content.”  As between you and TBC, you retain all right, title, and interest in and to your User Content.  You grant TBC a non-exclusive, worldwide, royalty-free, fully paid up, sublicensable, and transferable license to use, host, store, reproduce, adapt, modify, create derivative works of, perform, distribute, display, and otherwise process and exploit (collectively, “Use”) your User Content and the resulting Output solely (a) to operate, provide, secure, and maintain the Service for you, including to deliver Output to you, prevent abuse, and comply with applicable law and (b) in aggregated and/or deidentified form (including after the Term) to develop, operate, provide, secure, maintain, support and/or improve the Service, Software, and TBC’s other products, services, and technology.  Notwithstanding the foregoing, TBC will not Use your User Content or Output to train or fine-tune its models other than as necessary to provide the Service and Software to you. For the avoidance of doubt, aggregated or de-identified usage and telemetry data generated or collected in connection with your use of the Service and/or Software (for example, which features you use and whether you retained, downloaded, or reported a given Output) “Usage Data”) shall not be considered User Content or Output, and TBC may freely use such usage and telemetry data for any lawful purpose.  Usage Data does not include your Input or Output in a form that identifies you. TBC may also use, store, and process personal data included in your User Content and Output as described in our Privacy Policy.

As between you and TBC, and to the extent permitted by applicable law, you retain all right, title, and interest in and to your Output, and subject to the terms of this Agreement, may use your Output for any lawful purpose. TBC claims no ownership of your User Content or Output.  For clarity, notwithstanding anything to the contrary, nothing in this Agreement grants you any right, title, or interest in, and TBC and its licensors reserve all right, title, and interest in and to, the Service, the Software, the models, and any other underlying technology or intellectual property (including any third-party technology or intellectual property).  Because of the nature of artificial intelligence, Output may not be unique, and the Service may generate the same or similar Output for other users; TBC makes no representation that Output is original, non-infringing, or eligible for copyright or other intellectual-property protection, and you are solely responsible for evaluating Output and determining whether it is suitable for your purposes before relying on or using it. 

You represent and warrant that you own or have all rights, consents, and permissions necessary to submit your User Content and to grant the licenses above, and that your User Content, your use of the Service, and TBC’s use of your User Content and the resulting Output in accordance with this Agreement will not infringe, misappropriate, or violate any third party’s intellectual property, privacy, publicity, or other rights, or any applicable law, rule, or regulation.  You are solely responsible for your User Content and Output.

Privacy Policy

We may collect registration and other information about you through the Service and Software.  Our collection and use of this information is governed by the Privacy Policy available at www.tbc.co/privacy-policy.

Links and Third Party Services

The Service may be provided using, or may make available, or may link to, third-party models, software, infrastructure, products, services, and websites, including open-source components and model architectures made available under their own license terms. We exercise no control over, do not endorse, and are not responsible or liable for any third-party content, products, services, websites, or resources or for any damage or loss caused by your use of or reliance on them. Your use of any third-party content, products, services, websites, or resources may be subject to or limited by additional terms and conditions, and you are responsible for complying with all such terms and conditions.

Disclaimer of Warranties

YOUR USE OF THE SERVICE, SOFTWARE, AND ALL CONTENT MADE AVAILABLE VIA THE SERVICE AND SOFTWARE (INCLUDING WITHOUT LIMITATION OUTPUT) IS AT YOUR SOLE RISK.  THE SERVICE, SOFTWARE, AND ALL CONTENT MADE AVAILABLE VIA THE SERVICE AND SOFTWARE (INCLUDING WITHOUT LIMITATION OUTPUT) ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.  TBC EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ALL WARRANTIES ARISING OUT OF COURSE OF PERFORMANCE, COURSE OF DEALING, AND USAGE IN TRADE.  WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF THE SERVICE, SOFTWARE, OR ANY CONTENT MADE AVAILABLE VIA THE SERVICE AND SOFTWARE (INCLUDING WITHOUT LIMITATION OUTPUT), AND YOU RELY ON THE SERVICE, SOFTWARE, AND ALL CONTENT MADE AVAILABLE VIA THE SERVICE AND SOFTWARE (INCLUDING WITHOUT LIMITATION OUTPUT) AT YOUR OWN RISK.  TBC DOES NOT WARRANT THAT THE SERVICE, SOFTWARE, OR ANY CONTENT MADE AVAILABLE VIA THE SERVICE AND SOFTWARE (INCLUDING WITHOUT LIMITATION OUTPUT) WILL BE ACCURATE, COMPLETE, RELIABLE, ORIGINAL, NON-INFRINGING, OR FIT FOR ANY PARTICULAR PURPOSE.  ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY MATERIAL THROUGH THE SERVICE.  NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM TBC OR THROUGH OR FROM THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.  SOME STATES MAY PROHIBIT A DISCLAIMER OF WARRANTIES AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

Limitation of Liability

TBC WILL NOT BE LIABLE FOR ANY (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF TBC HAS BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES), RESULTING FROM YOUR USE OF THE SERVICE, SOFTWARE, OR OUTPUT OR (B) ANY LIABILITY OR AMOUNTS OF ANY KIND ARISING OUT OF OR RELATED TO THIS AGREEMENT (INCLUDING BUT NOT LIMITED TO WARRANTY CLAIMS), REGARDLESS OF THE FORUM AND REGARDLESS OF WHETHER ANY ACTION OR CLAIM IS BASED ON CONTRACT, TORT, OR OTHERWISE, THAT EXCEED, IN THE AGGREGATE, ONE HUNDRED DOLLARS ($100), EXCEPT AS PROVIDED IN THE SECTIONS TITLED “COMMENCING ARBITRATION” AND “ARBITRATION RELIEF”.  THE FOREGOING LIMITATIONS ARE A FUNDAMENTAL PART OF THE BASIS OF THE PARTIES’ BARGAIN AND WILL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.  BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Copyright Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide us with a description of the copyrighted work or other intellectual property that you claim has been infringed, a description of where the material that you claim is infringing is located on the Service, your address, telephone number, and email address, and a statement by you that this information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.  Please report this information by email to copyright@tbc.co.

Indemnity

You will indemnify and hold TBC, and its subsidiaries, affiliates, officers, agents, and employees, harmless from any costs, damages, expenses, and liability (including reasonable attorneys’ fees) caused by (i) your use of the Service, Software, or Output, (ii) your User Content, (iii) your violation of this Agreement, or (iv) your violation of any applicable law, rule, or regulation or of any rights of any third party.

Updates to this Agreement

We may occasionally update this Agreement.  When we do, we will revise the “last updated” date on the Agreement.  You should check this Agreement frequently to see recent changes.  By continuing to use your account, the Service, or Software, you consent to any updates to this Agreement.  This version of the Agreement supersedes all earlier versions.

Dispute Resolution and Arbitration 

Generally. Except as described in the Sections titled “Exceptions” and “Opt-Out”, you and TBC agree that every dispute arising in connection with this Agreement, the Service or Software, or communications from us will be resolved through binding arbitration. Arbitration uses a neutral arbitrator instead of a judge or jury, is less formal than a court proceeding, may allow for more limited discovery than in court, and is subject to very limited review by courts. This agreement to arbitrate disputes includes all claims whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of this Agreement. Any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement will be resolved by the arbitrator.

YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND TBC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

Exceptions. Although we are agreeing to arbitrate most disputes between us, nothing in this Agreement will be deemed to waive, preclude, or otherwise limit the right of either party to: (a) bring an individual action in small claims court; (b) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (c) seek injunctive relief in a court of law in aid of arbitration; or (d) to file suit in a court of law to address an intellectual property infringement claim.

Opt-Out. If you do not wish to resolve disputes by binding arbitration, you may opt out of the provisions of this Section titled “Dispute Resolution and Arbitration” within 30 days after the date that you agree to this Agreement by sending a letter to Biological Black Box, Inc. d/b/a The Biological Computing Co., Attention: Legal Department – Arbitration Opt-Out, 1500 Owens St, San Francisco, CA 94158, US, that specifies: your full legal name, the email address associated with your account on the Service, and a statement that you wish to opt out of arbitration (“Opt-Out Notice”). Once TBC receives your Opt-Out Notice, this Section titled “Dispute Resolution and Arbitration” will be void and any action arising out of this Agreement will be resolved as set forth in the Section titled “Governing Law”. The remaining provisions of this Agreement will not be affected by your Opt-Out Notice.

Arbitrator. This arbitration agreement, and any arbitration between us, is subject to the Federal Arbitration Act and will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (collectively, “AAA Rules”) as modified by this Agreement. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at +1-800-778-7879, or by contacting TBC.  

Commencing Arbitration. Before initiating arbitration, a party must first send a written notice of the dispute to the other party by certified U.S. Mail or by Federal Express (signature required) or, only if that other party has not provided a current physical address, then by electronic mail (“Notice of Arbitration”). TBC’s address for Notice is: Biological Black Box, Inc. d/b/a The Biological Computing Co., 1500 Owens St, San Francisco, CA 94158, US. The Notice of Arbitration must: (a) identify the name or account number of the party making the claim; (b) describe the nature and basis of the claim or dispute; and (c) set forth the specific relief sought (“Demand”). The parties will make good faith efforts to resolve the claim directly, but if the parties do not reach an agreement to do so within 30 days after the Notice of Arbitration is received, you or TBC may commence an arbitration proceeding. The payment of all fees will be governed by the AAA Rules.

Arbitration Proceedings. Any arbitration hearing will take place in the county and state of your residence unless we agree otherwise or, if the claim is for US$10,000 or less (and does not seek injunctive relief), you may choose whether the arbitration will be conducted: (a) solely on the basis of documents submitted to the arbitrator; (b) through a telephonic or video hearing; or (c) by an in-person hearing as established by the AAA Rules in the county (or parish) of your residence. During the arbitration, the amount of any settlement offer made by you or TBC must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. 

Arbitration Relief. Except as provided in the Section titled “No Class Actions”, the arbitrator can award any relief that would be available if the claims had been brought in a court of competent jurisdiction. If the arbitrator awards you an amount higher than the last written settlement amount offered by TBC before an arbitrator was selected, TBC will pay to you the higher of: (a) the amount awarded by the arbitrator and (b) US$10,000. The arbitrator’s award shall be final and binding on all parties. Judgment on the award may be entered in any court having jurisdiction.

No Class Actions. YOU AND TBC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. 

Modifications to this Arbitration Provision. If TBC makes any substantive change to this arbitration provision, you may reject the change by sending us written notice within 30 days of the change to TBC’s address for Notice of Arbitration, in which case your account with TBC will be immediately terminated and this arbitration provision, as in effect immediately prior to the changes you rejected, will survive.

Enforceability. If the Section titled “No Class Actions” or the entirety of this Section titled “Dispute Resolution and Arbitration” is found to be unenforceable, or if TBC receives an Opt-Out Notice from you, then the entirety of this Section titled “Dispute Resolution and Arbitration” will be null and void and, in that case, the exclusive jurisdiction and venue described in the Section titled “Governing Law” will govern any action arising out of or related to this Agreement.

Governing Law

This Agreement is governed by the laws of the State of California without regard to conflict of law principles. You and TBC submit to the personal and exclusive jurisdiction of the state courts and federal courts located within the County of San Francisco, California for resolution of any lawsuit or court proceeding permitted under this Agreement.

Miscellaneous

You may not assign this Agreement, by operation of law or otherwise, without our prior written consent, and any attempted assignment in violation of this section is void.  We may assign this Agreement without your prior written consent. This Agreement is the entire agreement between the parties relating to its subject matter and supersedes all prior or contemporaneous understandings.  No waiver or modification of this Agreement will be valid unless in writing and agreed to by us.  If any provision of this Agreement is held to be unenforceable, the remaining provisions will remain in full force and effect.

Acceptable Use Policy

Purpose and Scope

This Acceptable Use Policy (this “AUP”) is incorporated into and forms part of the Terms of Service available at www.tbc.co/terms-of-service, and governs your use of the Service and Software. It applies to all users. Capitalized terms not defined here have the meanings given to them in the Terms of Service. Violation of this AUP is a material breach of the Terms of Service and may result in immediate suspension or termination of access, removal of content, and, where appropriate or required, reporting to law enforcement.

Prohibited Content

You may not use the Service to create, upload, generate, submit, or distribute any content that:

  • Sexualizes minors. Depicts, describes, or sexualizes any person under 18. This is a zero-tolerance prohibition. Suspected child sexual abuse material will be preserved and reported to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law.
  • Is sexual or adult in nature. Any pornographic, sexually explicit, or otherwise adult (“NSFW”) content. This is a zero-tolerance prohibition.
  • Is non-consensual intimate imagery. Nude, intimate, or sexualized depictions of a real person created or shared without consent, including synthetic or “deepfake” imagery.
  • Depicts a real, identifiable person. The likeness, face, voice, or identity of any real, identifiable individual, including public figures.
  • Is deceptive or misleading. Content intended to deceive, including disinformation, election or political manipulation, impersonation, scams, or fraud.
  • Promotes hate or harassment. Content that harasses, defames, or incites hatred, discrimination, or violence against individuals or groups.
  • Promotes serious harm. Content that promotes, facilitates, or provides instructions for terrorism, violent extremism, self-harm, or serious violence.
  • Facilitates illegal activity. Content that facilitates illegal activity, including unlawful weapons, controlled substances, or chemical, biological, radiological, or nuclear harms, or otherwise violates any applicable law, rule, or regulations.
  • Infringes rights. Content that you do not have all rights necessary to provide, or that infringes or misappropriates any intellectual property, privacy, publicity, or other right of a third party.

Prohibited Conduct

You may not:

  • Use bots, scrapers, or other automated means to access the Service except as expressly permitted, or otherwise place an unreasonable load on the Service;
  • Circumvent, disable, or interfere with rate limits, content filters, safety systems, or other technical protections;
  • Reverse engineer the Service or Model, or extract, copy, or derive model weights or parameters;
  • Use the Service, Software, or any Output to train, develop, or improve any machine-learning or artificial-intelligence model, or any product or service that competes with or is substantially similar to the Service or TBC, including by distillation;
  • Probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measure;
  • Upload or transmit any viruses, malware, or other harmful code, or otherwise interfere with or disrupt the integrity, performance, or availability of the Service, Software, or the servers or networks connected to them;
  • Resell, sublicense, or provide access to the Service to third parties except as expressly permitted;
  • Remove, alter, or obscure any proprietary notices (including copyright notices) on any portion of the Service, Software, or Output;
  • Misrepresent your identity or affiliation, or impersonate any person or entity.

Safety Systems

We may deploy automated and manual systems to detect and prevent violations of this AUP. You may not attempt to bypass or defeat these systems. Whether and how we review content is described in the Terms of Service and Privacy Policy.

Enforcement

We may investigate suspected violations and may suspend or terminate access, remove or disable content, and preserve and disclose information to law enforcement or other authorities where we believe in good faith that doing so is necessary or required by law. We are not obligated to monitor the Service but may do so. Enforcement action may be taken with or without notice.

Changes to this Policy

We may update this AUP from time to time. Material changes will be communicated by reasonable means, and continued use of the Service after the changes take effect constitutes acceptance.
